New sex assault trial for soldier

OTTAWA – A former soldier who blamed post-traumatic stress disorder for a sexual assault has lost his attempt to get out of a second trial.

Roger Borsch was originally found not criminally responsible for attacking a 13-year-old girl in The Pas, Man., in 2004.

He said his mind had been affected by atrocities he witnessed a decade earlier while serving in Bosnia.

Last year, Manitoba's Court of Appeal overturned that ruling, saying the trial judge was too quick to accept Borsch's explanation, and ordered a new trial.

Borsch's lawyer wanted the Supreme Court of Canada to hear the case and let the original verdict stand, but the high court has ruled it won't do so.

A date for the new trial has not yet been set.
