Man facing 43 sex-related charges released on bail from Cape Breton jail

SYDNEY — A Nova Scotia man facing 43 sex-related offences involving young boys was released from a Cape Breton jail Thursday after posting $60,000 in bail and agreeing to abide by a host of conditions.
Ernest Fenwick (Fen) MacIntosh, 64, walked out of the Sydney Justice Centre after signing his release papers and spending 10 months behind bars at the Cape Breton Correctional Centre.
MacIntosh offered no comment as he walked by reporters waiting for him at the Sydney court house.
He had previously been denied bail but a further bail review last month resulted in a number of conditions being imposed in a bid to eliminate MacIntosh’s ability to flee the country.
Among the conditions of his release, MacIntosh is to complete a money transfer, within seven days, of a bank account held in Singapore and is to provide evidence to the Crown of that transfer. MacIntosh is prohibited from accessing the account which will be frozen.
Also, he is to transfer an account held in California to Nova Scotia from which he is only allowed to withdraw his bail amount.
MacIntosh will be living in the Halifax area and must report in person to Halifax Regional Police every Monday and Friday. He is to abide by a curfew between the hours of 8 p.m. and 7 a.m. and he is not allowed to possess or apply for a Canadian passport.
He is prohibited from being in the company of anyone under the age of 14 and must file with the Crown the make, model and licence plate of any vehicle he will have in his possession.
MacIntosh was arrested at his former home in Gurgaon, India, near the country's capital of New Delhi, in April 2007. A telecommunications specialist, he is charged with 43 sex-related offences including multiple indecent assault and gross indecency counts.
The offences alleged involve eight boys and were to have been committed during the 1970s when MacIntosh had several business interests in the Strait area and where he was involved with the minor hockey program.
The incidents are alleged to have occurred in communities including Port Hawkesbury, Port Hastings, Sydney, Mulgrave, Steep Creek, Port Shoreham, Guysborough and Halifax.
MacIntosh is now scheduled back in provincial court April 17 to enter pleas to the charges. He is also scheduled to appear in court May 23 for a prohibition application hearing filed by his defence lawyer.
The application contends that in accordance with the extradition treaty with India, MacIntosh can only be tried on the exact number of charges to which India granted extradition which would be less than the 43 offences he now faces.
