A teenager who was sentenced this week for sexually
assaulting a six-year-old girl won’t have his
name added to Canada’s sex offender registry,
after all.
Assistant Crown attorney Carey Lee brought the matter
back before the court yesterday, requesting that Ontario
Court Justice Norman Bennett rescind the order. Lee
said on double-checking the Criminal Code, he discovered
the youth could not be registered as a sex offender
unless the Crown had applied to sentence him as an adult.
That did not happen in this case. The accused was sentenced
in youth court to six months in custody, three months
on a community supervision order and two years of probation.
The boy’s DNA profile will still be registered
with the national DNA data bank.
The boy, who was 14 at the time, admitted to subjecting
the young girl to sexual intercourse on four or five
occasions between January and late March of 2007.
